INTRODUCTION

The general conditions of use and sale set out below indicate, in compliance with current consumer protection regulations, the conditions and methods with which any User can use the e-commerce sites at the domains www.planet-group.it and www.exactlabel.com and proceed with online purchases of products.
These conditions of sale govern the sale of both products manufactured and marketed by Planet Group S.r.l.

1 - Website Terms of Use

Access, use and any other use of the site are activities governed by these general conditions.
Visiting the sites www.planet-group.it and www.exactlabel.com, as well as purchasing the products promoted therein, imply knowledge and acceptance of these General Conditions. As for the processing of personal data, please read the information on the processing of personal data and the cookie policy published on the sites.
The use of the sites and the related orders can only be made by persons over the age of 18, therefore in using the services the User declares to be of age and is required to provide correct and truthful information. The User is solely responsible for the truthfulness, correctness and completeness of the information provided including that requested to obtain the credentials to access their account and the reserved sections of the sites. Any changes to personal details must be made by the User before placing the order.
The sites are dedicated to both wholesale and retail sales of the products present and/or customized.
If the User intends to request non-customizable products directly from the site, he/she can send the relevant request by sending an email to info@planet-group.it or info@exactlabel.com, or by calling +39 0721 283801 in order to receive information on the matter and obtain a specific quote.

2 - Products

All information and data regarding the products and reported on the sites, or in other documents of the seller, have indicative and illustrative value.
It is the User's responsibility before transmitting the order through the sites, to ensure that the products are suitable for the purpose and/or specific use for which he intends to purchase them.

3 - Orders

The order sent is confirmed by Planet Group s.r.l. by means of a confirmation sent by e-mail, which reports the number and date of the order, the date and costs of shipping, the price of the products and the quantities. All orders are subject to acceptance by Planet Group s.r.l.
Product prices are indicated in euros (€) net of VAT (excluding VAT) and are calculated based on the price list in force at the time of the order. Prices may vary as a result of market changes.
The User undertakes to verify the accuracy of all personal data contained in the order confirmation and to promptly communicate to the Seller any corrections and/or changes to be made. The sales contract will be binding for the seller only upon sending the order confirmation and receipt of the same by the User.
The acceptance and processing of orders transmitted via the sites is subject to the actual availability of the products at the time of receipt of the order proposal. The seller expressly reserves the right not to accept the order for any reason. In the event of non-acceptance of the order, the seller will promptly communicate this to the User.

4 - Order Processing Times

The order processing time is the time interval that passes from the receipt of the order to the delivery of the product to the courier.
All orders regarding products available in stock will be processed in 24 / 72 hours excluding holidays.
The processing times for products not available in stock will be communicated with a specific email.

5 - Shipping Methods and Costs Calculation

Shipping is entrusted to our partner couriers.
The shipping costs will be calculated automatically by our system based on the destination country and the total weight of the products.
For all orders over € 99.00, delivery is free.

6 - Payment Methods

Bank Transfer

In the case of payment by advance bank transfer, the order can only be processed after the actual crediting of the Planet Group s.r.l. current account. This crediting must occur within 5 working days from the date of acceptance of the order, after which the order is automatically considered cancelled.

Credit Cards

In the case of payment by credit card, at the same time as the transaction, the bank will authorize only the commitment of the amount relating to the purchase made.
The credit cards accepted are:

Online transactions by credit card are carried out directly by the bank via a secure server using a certified protection system.
Occasionally, the seller may request additional information from the User to verify his/her identity. In this case, the User will be contacted via email or telephone.

7 - Invoicing Methods

The billing methods are the same for both private individuals and commercial operators. In the case of payment by cash on delivery, the goods travel with the accompanying invoice consisting of a courtesy paper copy with subsequent sending to the Exchange System (S.D.I.).
In the case of advance payment, the relative advance invoice will be issued and then the zero balance invoice for the shipment with sending to the Exchange System (S.D.I.).

8 - Warranty, Liability for Defective Products, and Tolerances

The Seller guarantees the User that the Products supplied will be in good condition and compliant with the sales contract and must be correctly stored.
Planet Group s.r.l. declines all responsibility for defects caused by a long permanence of the labels in the warehouses of the User who must comply with the instructions provided in the packaging and/or in the technical sheets on the site.
If the User uses the Exact Label site to customize the adhesive labels and the file provided for printing does not comply with the guidelines in the instructions, Planet Group s.r.l. is exempt from any liability.

The color rendering of the colors of the finished product may not correspond to the image represented by computer monitors because it is linked to the color profile set and the material chosen during the order phase.
Therefore, in the absence of a color proof and/or print proof, Planet Group s.r.l. is exempt from any liability for any discrepancies.
The quantities ordered are subject to the following tolerance limits:

up to 10,000 labels tolerances of + / - 10%;
from 10,001 to 30,000 labels tolerances of + / - 8%;
over 30,000 labels tolerances + / - 5%.

Any tolerances other than those indicated above may be agreed upon at the time of ordering and/or may depend on the requested packaging.
The User, upon delivery of the products, is required to verify:

That the package is intact, undamaged and in any case compliant with the standard characteristics of a package;
That the number of packages indicated on the invoice or on the DDT corresponds to the number of packages actually delivered;
In the case of delivery on a pallet, verify that the film is intact, well-adherent and without abnormal openings.

The User, in the event of damage due to transport or in the event of suspicion of missing products, is required to sign the copy of the Transport Document (D.D.T.) of the courier by writing "I accept with reservation" specifying the reasons, otherwise reject the damaged goods. Without the written reservation, it will not be possible to claim for damages or shortages.
All products manufactured and marketed by Planet Group s.r.l. are covered by guarantees for manufacturing defects and/or conformity.
Pursuant to Article 1495 of the Civil Code, the deadline for reporting defects is:

8 days from receipt for apparent defects;
8 days from the day of discovery for hidden defects.

9 - Right of Withdrawal

The right of withdrawal is regulated by articles 52 and following of the Consumer Code.
The User has the right to withdraw from the relevant sales contract, without having to provide any reason within 14 days from the day on which the product was delivered, i.e. from the day on which the User or a third party other than the carrier and designated by the User himself, acquires physical possession of the goods. The period for exercising the right of withdrawal referred to above expires once 14 days have elapsed from the date of delivery of the goods to the User or to a third party other than the carrier.
The notice of withdrawal may be sent to the seller, alternatively, by registered mail with return receipt. sent to the address Planet Group s.r.l., via Toscana n.9 61122 Pesaro (PU), email, certified email, sent to: info@planet-group.it or info@exactlabel.com or planetgroupsrl@legalmail.it recalling the following information: order number and date, User data, bank details for the refund (only in case of payment made by advance bank transfer). In case of advance payment made by another means, the refund will be made using the same payment method used at the time of the order.
After sending the withdrawal notice, the User must return the products to the address indicated above within and no later than 14 working days from the date of sending the withdrawal notice. The costs of returning the product are borne by the User.
The right of withdrawal can be exercised in relation to a product purchased in its entirety and is not permitted for only a part of the purchased product.
You are not entitled to exercise the right of withdrawal for customized products.

10 - Events Beyond Our Control

Event Outside Our Control means any act or event outside the reasonable control of the Seller, including but not limited to strikes, lockouts or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure and/or malfunction of the Site, related applications and/or public or private telecommunications networks.
If an Event Outside the Control of the Seller occurs that affects the operation of the Site and/or the fulfillment of the Seller's obligations under these General Conditions:

the User will be contacted as soon as reasonably possible to inform him;
the Seller's obligations under these general conditions will be suspended and the deadline for fulfilling such obligations will be extended for the duration of the Event Outside Our Control.

In the event that the Event Outside Our Control affects the delivery times of the product, the seller will inform the User of the new delivery date following the resolution of the Event Outside Our Control.

11 - Applicable Law and Dispute Resolution

These General Conditions are governed by Italian law and will be interpreted in accordance with it. Consequently, the interpretation, execution and termination of these General Conditions are subject exclusively to Italian law.
The Seller is always available to seek an amicable solution to any disputes that may arise, through the contacts indicated in the preceding points.

In any case, the User retains the right to contact the competent ordinary judge for the dispute arising from these General Conditions, regardless of the outcome of the out-of-court settlement procedure, as well as the possibility, where the conditions exist, to promote an out-of-court resolution of disputes relating to consumer relationships by resorting to the procedures referred to in Part V, Title II - bis of the Consumer Code (Legislative Decree no. 206/2005).
If the User acts in the exercise of his/her entrepreneurial, commercial, artisanal or professional activity, the parties consensually establish the exclusive jurisdiction of the Court of Pesaro.

12 - Amendments and Updates

The Seller may unilaterally modify these General Conditions at any time.
The new version will be notified to Users by publication on the Site, with adequate advance notice with respect to its entry into force. The Seller will be responsible for specifying the reasons for the aforementioned modifications, providing all the details in this regard to the end consumer Users.
The new versions of the General Conditions will be effective from the date of publication of the same on the Site and in relation to Orders submitted after that date.
